2. Definitions
- ACL means the Australian Consumer Law.
- Consumer has the meaning given in the ACL (this can include purchases up to $100,000, and some higher value purchases in certain cases).
- Product means any goods we sell, including personalised or custom-made items.
- Personalised means made to your specifications (such as name, date, message, layout, colour, size, artwork, font, or material choices).
- Website means this website and any related services, forms, checkout, and account areas.
3. Using our website
- You must not use the Website for unlawful purposes, to interfere with site security, or to submit false or misleading information.
- We may suspend or restrict access to the Website or an account if we reasonably believe these Terms are being breached or the Website is being misused.
- We work hard to keep the Website available, but it may be unavailable at times due to maintenance, updates, or events outside our control.
4. Accounts
- If you create an account, you are responsible for keeping your login details secure and for activity on your account.
- Please ensure your contact and delivery details are accurate and up to date.
5. Product information
- We try to display products, colours and finishes accurately. However, screens can show colours differently and lighting can affect photos.
- Natural materials (for example timber, slate, coir) may vary in grain, texture, shade and markings. These variations are normal and not defects.
- Handmade and laser-processed products may have minor variations and tolerances that do not affect normal use.
6. Orders and contract formation
- Product listings are an invitation to treat only. When you place an order, you are making an offer to purchase in accordance with these Terms.
- A binding contract is formed when we send an order confirmation email or when we accept payment and begin work on your order, whichever occurs first.
- We may refuse or cancel an order before dispatch if products are unavailable, there is a pricing or description error, we suspect fraud, or payment cannot be authorised. If we cancel after payment, we will refund the amount paid for that order.
- You are responsible for checking your order details (including spelling, dates, sizing, materials, colours, quantities, delivery address and contact details) before finalising checkout.
7. Personalisation, proofs and design approvals
- For Personalised products, we rely on the information you provide. Please double check all names, dates, spelling, and choices before placing your order.
- If we provide a proof or mock-up, you must review it carefully and approve it (or request changes) before we proceed. Once you approve, you confirm the details are correct.
- If the final product matches the approved proof (or the details supplied where no proof is provided), issues caused by incorrect details supplied by you are considered change-of-mind (not a fault).
- You confirm you have the right to use any images, logos, artwork or text you submit and that it does not infringe someone else’s rights.
- You grant us a non-exclusive, royalty-free licence to use, reproduce and adapt content you supply for the purpose of producing your order and providing our services. If you prefer we do not share photos of your order for marketing, please tell us in writing before production starts.
8. Pricing, GST and payment
- Prices are in Australian dollars (AUD). Unless stated otherwise, Australian orders include GST.
- Shipping costs are calculated and shown at checkout.
- International orders may attract duties, taxes or customs charges in the destination country. These are the recipient’s responsibility.
- Payment must be made at checkout using the payment methods offered (for example card, PayPal, Afterpay or other supported options shown at checkout).
- If a payment provider charges you fees (for example international card fees), those are set by that provider and not by us.
9. Shipping and delivery
Shipping, delivery, tracking, and delivery issues are covered in our Shipping, Returns & Refund Policy, which forms part of these Terms.
10. Change of mind, cancellations and amendments
- Because Personalised products are made to order and cannot reasonably be resold, we generally cannot accept change-of-mind returns once production has started (unless the ACL requires a remedy).
- If you need to cancel or amend an order, contact us as soon as possible. If production has not started, we may be able to help, but changes are not guaranteed.
11. Australian Consumer Law and your rights
Our goods and services come with guarantees that cannot be excluded under the ACL. If a Product fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund, and in some cases compensation for reasonably foreseeable loss. Nothing in these Terms limits your rights under the ACL or any other law that cannot lawfully be excluded.
12. Faulty, damaged or incorrect items
If your order arrives faulty, damaged, or not what you ordered, please contact us with your order number and clear photos. We will work with you to resolve the issue in line with the ACL and our Shipping, Returns & Refund Policy.
13. Third party fulfilment partners
- Some products may be manufactured, warehoused or dispatched by carefully selected third party fulfilment partners, including partners located outside Australia.
- Even where a product is supplied via a fulfilment partner, your purchase contract is with T.Ess and we remain responsible for customer service and ACL compliance.
- We may share your name, delivery address and contact details with fulfilment partners solely to manufacture and deliver your order.
- Your order may arrive in more than one parcel where needed to supply all items.
14. Intellectual property
- Website content (text, images, designs, graphics, logos and software) is owned by us or our licensors and protected by intellectual property laws.
- You may view and use the Website for personal shopping purposes. You must not copy, reproduce, distribute or commercialise our content without written permission.
15. Reviews, photos and user content
- If you submit reviews, testimonials, photos or other content, you confirm you have the right to share it.
- You grant us a non-exclusive, worldwide, royalty-free licence to use that content for operating and promoting our business (for example on our Website and social media). We may edit or remove content that is inappropriate, misleading or unlawful.
16. Promotions, discount codes and offers
- Promotions may have specific terms displayed at the time of offer (for example minimum spend, exclusions, time limits, or one per customer).
- Unless stated otherwise, promotions cannot be exchanged for cash and cannot be combined with other offers.
17. Gift cards and store credit
- Where we sell gift cards in Australia, they will generally have a minimum expiry period of 3 years from the date of supply (unless an exemption applies under law). The expiry date will be clearly shown.
- Gift cards and store credit are not usually redeemable for cash and should be treated like cash, as lost or stolen cards may not be replaceable.
18. Optional third party tools and links
- We may provide access to third party services (for example payment gateways or shipping integrations). These services are provided by third parties and may have their own terms.
- The Website may contain links to third party sites. We are not responsible for their content, security or privacy practices.
19. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including your rights under the ACL.
20. Changes to these Terms
We may update these Terms from time to time by publishing the updated version on this page. The version that applies is the one in effect when you place your order.
21. Governing law
These Terms are governed by the laws of New South Wales, Australia. Courts in New South Wales have non-exclusive jurisdiction.
